Terms and Conditions

1st Alliance Garage Doors

  

1. Agreement

These Terms and Conditions (“Agreement”) are incorporated into and made part of every estimate, quote, proposal, invoice, or contract issued by 1st Alliance Garage Doors (“Contractor”).

The “Customer” refers to any homeowner, property owner, or contractor engaging Contractor for services.

This Agreement is non-transferable and non-assignablewithout written consent from Contractor.

  

2. Scope of Services

Contractor agrees to perform services in a professional and workmanlike manner consistent with generally accepted industry standards in the State of Missouri.

Unless expressly stated in writing, services do not include:

  • Painting or touch-up work 
  • Electrical, carpentry, drywall, masonry, or other trades 
  • Structural modifications 

  

3. Estimates

  • All estimates are valid for 30 calendar days from the date issued. 
  • After 30 days, pricing and availability may change. 
  • Estimates are based on the visible and known conditions at the time of inspection. 
  • Any changes to scope may result in additional charges. 

  

4. Acceptance of Work

  • Estimates become binding only upon written approval by Customer. 
  • Written approval includes electronic acceptance, email confirmation, or signed agreement. 
  • Approval authorizes Contractor to schedule work and order materials. 
  • Any changes or cancellations after approval must be agreed to in writing and may result in additional charges. 

  

5. Payment Terms

Residential Customers

  • A minimum deposit of 50% is required prior to scheduling and/or ordering materials. 
  • Deposits are non-refundable once materials are ordered or work is scheduled.      
  • Remaining balance is due immediately upon completion. 

Contractor/Commercial Customers

  • Payment is due upon completion, unless otherwise agreed in writing. 
  • Net terms shall not exceed 45 days from invoice date. 

Late Payments

  • Past due balances may incur: 
    • A $25  monthly late fee, or 
    • Interest up to 18% annually (or the maximum allowed by Missouri law) 
  • Customer agrees to pay all costs of collection, including: 
    • Attorney’s fees 
    • Court costs 
    • Collection agency fees 

      

6. Special Orders & Materials

  • Special-order materials are non-cancelable and non-refundable once ordered. 
  • Customer is responsible for verifying product specifications before installation. 
  • Any exchanges not due to damage or Contractor error will incur: 
    • Restocking fees 
    • Price differences 
    • Additional labor or service charges 
  • Contractor is not responsible for manufacturer delays or supply chain issues. 

  

7. Scheduling, Delays & Access

  • Customer must provide safe and timely access to the worksite. 
  • Delays caused by Customer (including failure to prepare site) may result in  additional charges. 

Contractor shall not be liable for delays caused by:

  • Weather      
  • Material shortages 
  • Labor issues 
  • Acts beyond reasonable control (“Force Majeure”) 

  

8. Site Conditions & Customer Responsibilities

Customer agrees to:

  • Remove or protect all personal property, including vehicles, furniture, and      valuables 
  • Keep children, pets, and occupants away from the work area 
  • Ensure proper structural readiness (including door jambs/casings) 

Door Openings

  • Proper casing/jambs must be installed prior to installation 
  • If not, Contractor may proceed at Customer’s request but: 
    • Will not be responsible for resulting damage 
    • Warranty may not apply to related issues 

      

9. Change Orders

Any deviation from the original scope must be approved in writing and may result in additional costs and schedule changes.

  

10. Limited Warranty

Coverage

  • 1 - year labor warranty 
  • 1 - year parts warranty (on replaced components) 

Manufacturer warranties may apply separately.

Conditions

  • Customer must notify Contractor of any visible issues within 48 hours of  completion 
  • Contractor must be given a reasonable opportunity to inspect and repair 

Failure to do so may limit warranty claims, but does not eliminate rights under this limited warranty.

Exclusions

Warranty does not cover:

  • Normal wear and tear 
  • Misuse, neglect, or improper maintenance 
  • Damage caused by third parties 
  • Pre-existing structural issues 
  • Lack of proper framing or support 

  

11. Limitation of Liability

To the fullest extent permitted by Missouri law:

  • Contractor’s  total liability shall not exceed the total amount paid by Customer 
  • Contractor shall not be liable for: 
    • Indirect or consequential damages 
    • Loss of use, income, or property 

      

12. Right to Stop Work

Contractor reserves the right to stop work immediately if:

  • Payments are not made when due 
  • Site conditions are unsafe 
  • Customer breaches this Agreement 

Customer will remain responsible for all costs incurred up to that point.

  

13. Mechanic’s Lien Rights (Missouri)

Customer acknowledges that Contractor has the right to file a mechanic’s lien under Missouri law for unpaid labor or materials.

Failure to pay may result in a lien against the property.

  

14. Indemnification

Customer agrees to indemnify and hold Contractor harmless from claims arising from:

  • Unsafe conditions at the property 
  • Failure to secure the worksite 
  • Actions of third parties not under Contractor’s control 

  

15. Privacy & Communications

Customer authorizes Contractor to contact them via:

  • Phone      
  • Email      
  • Text message 

for service-related and business communications.

Contractor does not sell or share personal information with third parties, except as necessary to perform services or comply with law.

  

16. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Missouri.

  

17. Entire Agreement

This document, along with any approved estimate or invoice, constitutes the entire agreement between the parties and supersedes all prior discussions.
